How did We Get here?
Legal Pennsylvania sports betting came to fruition because of two major events. Pennsylvania passed an omnibus gaming expansion package in October 2017, which included language to legalize and regulate sports betting in the event that federal law ever allowed states to offer sports betting. The second event occurred in May 2018, when the United States Supreme Court decided that the Professional and Amateur Sports Protection Act (PASPA), a 1992 federal law that banned sports betting outside of Nevada, was unconstitutional.
Sports Betting Revenue Potential
Estimates for projected revenue in Pennsylvania are around $400 million per year according to Gambling Compliance. These numbers seem a bit high but not unattainable. It was feared that the high tax rate of 36% may increase the amount of juice they offer on bets and marketing promotions, but so far this has not been the case. Pennsylvania Sports Betting History
Up until the May 2018 United States Supreme Court decision to overturn PASPA, a 1992 law that banned sports betting in the United States outside of Nevada, you had very limited options if you wanted to place a sports bet in Pennsylvania. One was a trip to Las Vegas, and the others included betting on an offshore website or placing a bet with an illegal bookie.
In 2017, State Rep Rob Matzie introduced H519, a massive gambling expansion package that included daily fantasy sports, iLottery, online gambling, online poker, and satellite casinos. This bill also included language to legalize and regulate Pennsylvania sports betting if and when the federal ban (PASPA) was ever lifted. This bill was signed by Gov. Tom Wolf in October 2017.
In May 2018, PASPA was overturned after a nearly 10-year fight, led by Senator Ray Lesniak of New Jersey. This decision opened the door for individual states to make their own decision on whether or not to allow sports betting within their own borders.
Nearly 13 months later, Hollywood Casino at Penn National took Pennsylvania’s first sports bet on November 16, 2018. Since then, eight other sportsbooks have opened their doors with three more expected to open in 2019. Online and mobile wagering is now live as well.
