New Jersey Sports Betting History

Up until recently, sports betting was restricted to Nevada in the United States, thanks to PASPA, the Professional and Amateur Sports Protection Act of 1992. When Congress passed the law, they offerred states a one year window to pass legislation to allow sports betting, but only Nevada ended up taking advantage.

The story takes us next to 2009, where Senator Ray Lesniak started rallying to challenge PASPA as unconstitutional, violating the 10th amendment. Lesniak had good reason to fight for New Jersey’s right to offer sports betting, as it was estimated that illegal offshore sites were reaping the rewards that could net New Jerseys upwards of $100 million in tax revenue for the state.

Moving forward to 2011, a constitutional amendment that would allow sports betting both in person and online was voted on and approved by 64% of voters in the Garden State and led Lesniak to introduce the Sports Wagering Act in order to moved forward with legal and regulated sports betting in the state. NJ lawmakers passed the Act and Governor Chris Christie quickly signed it into law.

Before any wagering began, New Jersey was promptly sued by the NHL, MLB, NBA and NFL in order to block any progress. In 2013, a judge sided with the leagues, and the initial appeal had similar results but Christie was not going to let this one go. The Governors plan was to remove state regulations and he believed this would not violate PASPA. Once again the leagues moved to squash the plan but this time, the appeals landed them in front of the US Supreme Court.

On December 4, 2017, the US Supreme Court came to a 6-3 decision in favor of striking down PASPA, and this decision opened the floodgates for legalized and regulated sports betting on state by state basis in the US. New Jersey wasted no time in getting started and by June 2018, sports betting officially kicked off with Governor Murphy placing a $20 bet on the New Jersey Devils to win the Stanley Cup.
